Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("the Client") and INNOVATECH GROUP (PTY) LTD (registration number 2017/044479/07), trading as Innovatech Group, of Buitengracht Street, Cape Town, Western Cape, South Africa, 8001. By opening an account, placing an order, or using any service at innovatechgroup.co.za, you accept these Terms.

1. Services

We provide shared and reseller cPanel web hosting, business email hosting, domain registration and related professional services, as described on our website at the time of your order. Service specifications, storage limits and included features are those published for the plan you purchase.

2. Your account

You must be at least 18 years old, or be authorised to contract on behalf of a business, to hold an account. You are responsible for the accuracy of the contact details on your account, for keeping your login credentials confidential, and for all activity that takes place under your account.

3. Fees, billing and renewal

All fees are quoted and payable in South African Rand. Services are billed in advance on the cycle you select at checkout — monthly or annually — and renew automatically at the then-current price unless cancelled before the renewal date. Invoices are issued to the email address on your account. Domain registrations and renewals are payable in advance and are non-refundable once lodged with the registry.

4. Late payment and suspension

We may suspend a service where an invoice remains unpaid after its due date and the reminders we have sent. Suspension does not relieve you of fees accrued. Data on a suspended account is retained for a reasonable period before deletion; we will tell you what that period is before deleting anything.

5. Cancellation

You may cancel a service at any time from the client portal, effective at the end of the paid period. Fees already paid for the current period are not refunded on cancellation unless we agree otherwise in writing or the law requires it.

6. Your content

You retain ownership of the content, data and software you place on our infrastructure. You warrant that you have the rights to it and that it does not infringe the rights of others. Your use of our services is also governed by our Acceptable Use Policy, which forms part of these Terms.

7. Availability and backups

We maintain our infrastructure to a high standard, but no hosting service is uninterrupted or error-free. Scheduled maintenance is announced in advance where practicable. Weekly backups are taken as a service courtesy and are not a substitute for your own backups; you remain responsible for retaining independent copies of anything you cannot afford to lose.

8. Limitation of liability

To the extent permitted by law, our aggregate liability arising from or connected to the services is limited to the fees you paid us for the affected service in the three months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profit, revenue, goodwill or data. Nothing in these Terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act 68 of 2008 where it applies to you.

9. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. If a dispute arises, both parties agree to attempt in good faith to resolve it directly before commencing proceedings. The parties consent to the jurisdiction of the Magistrate's Court having jurisdiction, without limiting our right to proceed in a higher court.

10. Changes

We may amend these Terms. Material changes will be communicated to the email address on your account at least 30 days before they take effect, and continued use after that date constitutes acceptance.
